The 4th Annual Forum | Channel Island & Isle of Man 2026 has successfully concluded, bringing together leading practitioners from offshore and onshore jurisdictions to discuss the latest developments in fraud, asset recovery, insolvency, and international dispute resolution.


Vicari Avvocati was pleased to contribute to this important discussion through Michele Jeni’s participation in the panel “Exploring Trust Structures and the Assets Involved”, where he shared an Italian civil law perspective on issues that remain central to asset protection in cross-border matters.

Two key themes emerged from his contribution:

- Foreign trust structures before Italian courts. Not all structures withstand scrutiny. Italian case law has progressively refined the criteria for assessing the essential elements of a trust and the genuineness of the fiduciary arrangement. A considered drafting of a trust instrument intended to have connections with Italy is not a formal exercise: it is the first line of defence for the assets.

- In the same cross-border dynamic: sham trusts and the Italian action for “simulazione”. The comparison between the common law sham trust doctrine and the Italian action for simulazione is richer — and more complex — than it may appear at first sight; particularly as regards the evidential framework available in litigation.
